Tenant Issues

    Ladies and Gentlemen,

    My tenant has been violating some parts of the lease agreement. Some of the main violations:

    1. It appears that my tenant has sublet my property to another person that is not on the lease agreement. This is based on the reports from my tenant's neighbors and the stuff I have found in the back yard of the rental property which does not belong to my tenants.

    2. The property locks have been changed without my knowledge and consent.

    3. Damage to the property is not being reported and maintenance requests for repairs are not being made.

    4. Installation of above ground swimming pool on the deck which is prohibited by the lease agreement.

    5. I discovered damage to property during routine inspections but tenant does not respond to phone calls made to schedule repairs and neither can I enter the property as permitted by the lease because the locks have been changed.

    I do not have a property management company. Please advise how I should be handling this situation. I do not mind hiring an attorney and proceeding legally.

    This is a horrible situation for you and whomever is currently occupying the property (as they might be unaware).

    I am confident that Jesus and Robin will give excellent advice to help you through this problem. They are much more experienced then myself so I am not going to add to what they have already told you. I did want to say that situations like this magnify the paramount importance in having a good lease. You said that they are in violation of parts of the lease agreement. It sounds like you have clauses in the lease to help you address the problem. Although it might not seem like it right now, this will be a great benefit to you in taking action.

    When starting out I had talked with other landlords about leases and some had very simple one page contracts. They are not so fortunate in these types of situations. I have found that with most tenant issues it helps if you can quote the lease.

    I don’t recall the last time there has been a meeting / class about leases.
