Building Code Grandfathering

    Hello Everyone,

    I am looking for information on building code grandfathering. What is the Texas law on building code grandfathering? How to landlords handle the purchase, sale or renting of a 40 or 50 year old house which may no longer be compliant with the current building codes and bringing it up to code may not be be practical without demolishing most of the house. Thanks in advance.

    Please be aware that local governments do NOT treat investors the same as owner occupants. Example: One city I flip in will allow a homeowner to do a garage conversion without pulling any permits. If a non-homesteader tries to do a garage conversion he must submit a plan and have the applicable permits pulled (i.e. electrical, mechanical, etc).

    I think you need to talk to the local departments and not the state. The grandfather concept might not give you the protection and flexibility you are hoping for.
